LAS VEGAS FATHERS RIGHTS WIN

In late July our office won a father temporary primary custody of his infant daughter.  Judge Kenneth Pollock ordered that the mother's visitation is suspended until she can demonstrate to the Court that she is drug free.  The father will receive child support.


Nevada recognizes the rights of a father as being equal to a mother's.  If the Judge finds that joint custody is not in the child's best interests then custody will not be shared.  In the instant matter, Judge Pollock ordered primary custody to the father due to the mother's drug use.  Such behavior by a parent will typically result in the drug-free parent receiving primary custody.

EQUAL RIGHTS FOR A NEVADA FATHER

The Ciciliano Law Office gained a Nevada father joint physical custody of his daughter on July 18th, 2011.  Judge Robert Teuton will be entering an Order stating that our Client has joint physical custody and that our Client will pay a reduced amount of child support due to his having to support other children.

NEVADA CHILD CUSTODY WIN

Our office won a Nevada father joint physical custody of his child on July 5th, 2011.  Judge Giuliani held that it was in the child's best interests to have the minor child Tuesday through Friday of each week.  The child's mother had requested primary physical custody.

CONTEMPT WIN FOR THE CICILIANO LAW OFFICE

The Ciciliano Law Office won a contempt hearing on June 16th, 2011.  Judge Teuton ordered that the Defendant, who had not paid his child support, must pay $1,000 to our Client within thirty days or the Defendant will serve 25 days in the Clark County Detention Center.

NEVADA DIVORCE WIN FOR CICILIANO LAW OFFICE

We successfully gained a Nevada divorce for our Client on May 31st, 2011.  In a case where our Client was concerned about losing a large portion of his pension to divorce, Judge Henderson ordered that the spouse will receive less than her proportional pension share in exchange for our Client accepting the marital residence and mortgage.  As a result, our Client was able to preserve the bulk of his pension.

NEVADA SUPREME COURT ISSUES LANDMARK DECISION

The Nevada Supreme Court has defined the jurisdiction of Judges presiding in the Family Division of the Eighth Judicial District.  In Landreth v. Malik, the Court held that Judges in Family Court have the same powers as Judges serving in the general District Court.  The difference is that Family Court Judges also have jurisdiction to hear issues dealing with family law.


It can be argued, under this decision, that Family Court Judges now have greater power than Judges serving in general District Court.  This decision is likely to create a level of confusion as to what matters may be heard in Family Court.
