NEVADA SUPREME COURT ISSUES LANDMARK DECISION

The Nevada Supreme Court has defined the jurisdiction of Judges presiding in the Family Division of the Eighth Judicial District. In Landreth v. Malik, the Court held that Judges in Family Court have the same powers as Judges serving in the general District Court. The difference is that Family Court Judges also have jurisdiction to hear issues dealing with family law.

It can be argued, under this decision, that Family Court Judges now have greater power than Judges serving in general District Court. This decision is likely to create a level of confusion as to what matters may be heard in Family Court.

This blog has previously discussed that the rights of Nevada fathers are equal to that of a mother. Nevada law presumes that parents should share joint physical custody of their children. A parent has joint custody whenever he or she enjoys the child at least 40 percent of the time. Rivero v. Rivero. Nevada law, therefore, presumes that fathers should have custody of their children at least 40 percent of the time. As a practical matter, Clark County Courts will attempt to keep a time share as close to even as possible.

In order for a parent to gain primary custody (a situation where the non-custodial parent will have the child less than 40 percent of the time) the parent requesting primary custody must show that joint custody is not in the child's best interests. In determining what is in a child's best interests, the Court will consider factors such as:

Which parent has traditionally cared for the child.
The level of conflict between the parents.
The ability of each parent to meet the child's needs.
The mental and physical health of the parents.

The Nevada Supreme Court has held that criminal defendants are not entitled to be sentenced by the same Judge who accepted their guilty plea. In the case of Dieudonne v. State, the Defendant contended that since Judge Gonzalez took his plea that he was entitled to have her conduct his sentencing. The Court rejected this argument and held that a Defendant does not gain such an entitlement unless it is an express part of the plea agreement.

As a result of this ruling, Dieudonne's sentence has been affirmed.

William “Bill” Kephart has been a lifetime resident of southern Nevada. Bill's wife of twenty years, Tina, is also a lifetime resident of southern Nevada. Together, they have raised two children, Bill's stepdaughter Jeanine and son Matthew.

Bill graduated from Basic High School in 1979. He attended the Univer-sity of Nevada Las Vegas, receiving a Bachelor of Arts and Letters De-gree in Criminal Justice. He then attended Cleveland –Marshall Col-lege of Law, earning his juris doctorate in May 1988.

Bill has presented a number of instructional seminars at various schools within Clark County, in-cluding UNLV, University of Phoenix, and the Community College of Southern Nevada.

The District Attorney's responding brief did not address Appellant's Crawford challenge even though several pages were devoted to the topic in Appellant's opening brief. MIRANDA WARNINGS LIMITED TO 14 DAYS

The US Supreme Court has held that a Miranda warning will remain in effect for up to 14 days after a suspect is released from interrogation. In Maryland v. Shatzer, the Court held that a prison inmate's prior invocation of his Miranda rights did not carry over to a subsequent in prison interrogation regarding the same offense.

The Supreme Court's ruling was without dissent and highly understandable as two years time separated the two investigations. It is unusual, while not unheard of, for the Supreme Court to announce a bright line time rule - such as saying in this case that Miranda warnings will remain in effect for 14 days after release.

Shatzer's conviction is now considered upheld.

The Nevada Supreme Court has held that parties in a custody case will maintain their right to have child support orders reviewed. In Fernandez v. Fernandez, the Court held that, even though the parties had agreed that their child support order would be non-modifiable, that the father could still seek modification due to his changed circumstances. Accordingly, child support orders will remain modifiable if there is a change in circumstances or if it has been three years since your most recent support order.

US SUPREME COURT REMANDS A MURDER CONVICTION

The United States Supreme Court has remanded a murder conviction which contained highly unusual facts. In Wellons v. Hall, the Court considered a case where the Judge had engaged in improper jury communications, the jury had planned a reunion with the bailiff, and the jurors had given the Judge and Bailiff unusual gifts.

The Supreme Court held that the Defendant is entitled to an evidentiary hearing to determine what exactly happened during the trial (as the record is almost non-existent). In so holding, the Court stated that "from beginning to end, judicial proceedings conducted for the purpose of deciding whether a defendant shall be put to death must be conducted with dignity and respect."
